1. Terminology

1.1 Offer: All the products and services and their prices (including discounted) offered by WRTTN Media.

1.2 Withdrawal period: The time period in which a consumer has the right of withdrawal.

1.3 Service: The services provided by WRTTN Media.

1.4 The right of withdrawal: The right of the consumer to withdraw their purchase within the agreed upon time period

1.5 User/Client: A consumer or customer who has accepted the terms and conditions of WRTTN Media.

1.6 Agreement: The agreement between WRTTN Media and the user/client.

1.7 Written : Electronic communication such as email, or other written communication through analog or digital means that have taken place by the User/Client or WRTTN Media respectively.

1.8 WRTTN Media: Registered under number 82247129 at the Dutch Chamber of Commerce (KvK), the Contractor of Natasja writes & unearth my roots, and these Terms of Service.

2. General

2.1 This Website is operated by Natasja. She offers this Website, including all information, tools and services available from this site to you, the User, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

2.2 By visiting the Website and/or purchasing something from me, you engage in my “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Return Policy,” “Privacy Policy”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all Users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2.3 These general terms and conditions apply to all offers and agreements between WRTTN Media and the Client, unless expressly agreed otherwise in writing. Any other conditions of the Client do not apply, unless they have been expressly accepted in writing by WRTTN Media.

2.4 If a stipulation from these terms and conditions is fully or partially in conflict with a legal condition or is nullified, then these terms and conditions remain in full force. The parties will jointly agree on a new stipulation that is in line with the void stipulation.

2.5 WRTTN Media reserves the right to change or supplement the Terms of Service and Conditions. Changes are communicated in a timely manner and in writing.

2.6 If the Client does not want to accept a proposed change, the Client can choose to terminate the agreement until the date on which the new terms and conditions take effect. Your continued use or access to the Website, products, or services after the new terms take effect constitutes acceptance of those changes.

2.7 WRTTN Media reserves the right to delete comments that are copyright infringement or defamatory, abusive, or hateful in nature.

2.8 Dutch law applies exclusively to the Terms of Service, Conditions and associated Agreements.

3. Products and Services

3.1 WRTTN Media puts offers on the Website, orally and/or through other written forms of communication. Agreements which have not been written down, become binding after a written confirmation from WRTTN Media.

3.2 WRTTN Media may change the offer, its contents, and its price at any time. The offer as accepted by the Client, however it was offered at that time, is the prevailing offer. All other written offers from WRTTN Media are valid for 14 days after the offer date, unless explicitly stated otherwise in the offer. If the Client has not accepted the offer within the aforementioned time period, the offer will expire unless an extension of the offer has been agreed upon in writing. After the expiry of the offer, WRTTN Media is entitled to change their offer.

3.3 All products and services are subject to obvious errors in their offer, such as an unreasonably and unrealistically high discount or an unusually low asking price.

3.4 The Customer can accept the offer by ordering and paying for the agreed amount on the Website, by accepting a bid proposal or signing a model agreement.

3.5 WRTTN Media’s obligations never go beyond what has been confirmed in writing.

3.6 The offer is based on the information provided by the Client, on which WRTTN Media relies for its accuracy and completeness.

3.7 As an exception to the other stipulations of this clause, the agreement between the Customer and WRTTN Media is only established after WRTTN Media has been informed, within the legal frameworks, whether you can meet your payment obligations and other factors that determine whether you can enter into an agreement in a responsible manner. When found insufficient, WRTTN Media has the right to not enter into the agreement, to dissolve it, or to attach special conditions to the agreement.

4. Cooperation by the Client

4.1 The Client will always provide WRTTN Media with all the data or information that is useful and necessary in a timely manner for the proper execution of the agreement and the Client will provide full cooperation.

4.2 The Client guarantees the correctness, completeness, and reliability of the information provided, even if it originates from third parties.

4.3 If the execution of the agreement is delayed because the Client fails to fulfill their obligation referred to in Article 4.1 or if the information provided by the Client does not comply with the provisions of Article 4.2, the resulting additional costs will be covered by the Client, and WRTTN Media is authorized to charge compensation for the additional work that has become necessary as a result.

5. Execution

5.1 WRTTN Media will execute the agreement to the best of its knowledge and ability in accordance with the requirements of good workmanship.

5.2 When executing the agreement, WRTTN Media will take into account the reasonable wishes of the Client as much as possible, provided that—after assessment—this is conducive to a proper execution of the agreement.

5.3 If and insofar it is required for proper execution of the agreement, WRTTN Media has the right to have certain activities performed by third parties.

6. Changes and Additional Work

6.1 The parties may agree in the interim that the approach and scope of the agreement and/or the resulting activities will be expanded or changed. Additional work will in principle only be performed by WRTTN Media if an additional written agreement has been signed by both the Client and WRTTN Media.

6.2 If the agreement is amended or supplemented, WRTTN Media is entitled to adjust and increase compensation accordingly to the usual rates of WRTTN Media.

6.3 The Client accepts any changes to the work as referred to in Article 6.1 may affect the agreed or expected time of completion of the agreement.

6.4 If, in the opinion of WRTTN Media, a change in the execution of the agreement is necessary to meet the obligations towards the client, WRTTN Media is authorized to make that change within reason and fairness.

7. Compensation

7.1 For offers provided through the Website, all amounts stated include VAT, unless otherwise agreed. All other prices (for offers not through the Website) are exclusive of VAT and other government levies, unless otherwise explicitly agreed.

7.2 For offers not provided through the Website, the Client and WRTTN Media can decide on an hourly rate of a fixed fee during the conclusion of an agreement.

7.3 For services or products not purchased through the Website, WRTTN Media will send a (digital) invoice for the agreed amount, unless otherwise agreed.

7.4 Travel and accommodation costs are not included in the compensation, nor are any other costs and advances.

7.5 If no compensation has been agreed upon between the Customer and WRTTN Media, then the customary fee used by WRTTN Media applies. When no customary compensation applies, WRTTN Media will charge a reasonable and fair compensation for the rendering of products or services.

8. Payment

8.1 For offers provided through the Website, services or products must be paid directly and via the Website, unless otherwise agreed.

8.2 PayPal is the accepted method of payment for purchases provided through the Website.

8.3 For services or products not purchased through the Website, the payment by Client must be made within 14 days of the invoice date to a designated bank account by WRTTN Media.

8.4 In this case of Article 8.3, the Client must pay 50% of the agreed compensation in advance, unless the parties have agreed otherwise in writing.

8.5 If the Client does not pay the amount owed within the agreed term, they will be in default and notice of default will not be required. WRTTN Media is authorized to hand over the claim, in which case, in addition to the total amount owed, the Client will also be obliged to compensate for extrajudicial and legal costs, the amount of which is determined at 15% of the total amount owed.

8.6 If the Client objects to an invoice from WRTTN Media, the Client will need to inform WRTTN Media within 14 days of the date of the invoice. The Client has up to 14 days after the invoice date to substantiate their objection in writing. If the Client has not complied with the aforementioned, the Client is deemed to have accepted the invoice.

9. Force majeure

9.1 In the event of force majeure, the delivery and other obligations of WRTTN Media will be suspended. In that case, WRTTN Media is obliged to deliver as soon as this is reasonably possible. Force majeure is equated with unforeseen circumstances with regard to people and/or material that WRTTN Media uses or tends to use in the execution of the agreement, which are of such a nature that the execution that the execution of the agreement is therefore is impossible, or so inconvenient and/or it becomes disproportionately expensive that the prompt compliance with the agreement cannot reasonably be followed by WRTTN Media.

9.2 The following qualify as such circumstances: natural disasters, epidemics and pandemics, interruptions in the supply of power, restrictive measures and directions from the government, illness and other circumstances beyond the control of WRTTN Media. If WRTTN Media has already partially fulfilled its obligations when the force majeure occurs, WRTTN Media is entitled to invoice the already completed work separately and the Client is obliged to pay this invoice as if it concerns a separate transaction.

10. Cancellation Policy

10.1 WRTTN Media reserves the right to cancel agreements by law, regulation, jurisdiction, or government policy that can no longer be extended by WRTTN Media. In such cases, WRTTN Media will notify the Client in writing. The Client is not entitled to claim compensation.

11 Right of Withdrawal

11.1 Premature termination of an agreement is only possible if both WRTTN Media and the Client have expressly agreed in writing or upon payment of the amount owed until the original end of the agreement, unless both parties have agreed on a different payment in writing.

11.2 Unless otherwise agreed in writing, when accepting the offer of a Service, the Client agrees that the agreement will be executed and fulfilled immediately. At the time of accepting the offer, the Client waives their right to dissolution.

11.3 Unless otherwise agreed in writing, in the event that a service is not performed immediately, but in parts, the Client has a 14-day withdrawal period after purchase. Cancellations are only accepted in writing via email to WRTTN Media.

11.4 In the case of Article 11.3, if the service begins before the expiry of the right of withdrawal, the Client will receive a pro rata refund of 50% of the price upon cancellation via email. If the service is completed within those 14 days, no reimbursement will be given.

11.5 The right of withdrawal is not applicable to downloads and other deliveries of digital content (those not delivered via a material carrier), if the Client prior to delivery expressly has agreed to commence performance of the contract before the end of the withdrawal period and has acknowledged that they will lose the right of termination when granting this permission.

11.6 When the Client makes use of the right of withdrawal, all additional agreements are dissolved by operation of law.

12. Intellectual Property

121 WRTTN Media is the intellectual property owner of all works made by Natasja, including but not limited to works viewable via the Website and works created, delivered, shown, sent by WRTTN Media. The Client may therefore not disclose, publish, or reproduce these works without prior written permission from WRTTN Media.

12.2 To the extent that WRTTN Media is not the rightful owner of works or materials, WRTTN Media has a valid license. These works are not allowed to be reproduced or made public without the permission of the copyright owner.

12.3 The Client must respect the personality and branding rights of the title holder, as stated in Article 25 Copyright law.

12.4 All videos, emails, downloads, schedules, checklists, stories, templates, modules, (work)books, and/or other materials are personal and may not be shared with third parties nor may they be reproduced or made publicly available, this includes publishing or sharing a part or all of these materials on the internet. In addition, unless otherwise agreed, the Client is not authorized to sublicense to third parties. However, the Client may download, save, or print the works for strictly personal use.

12.5 Deviating agreements are recorded in writing.

13. Liability

13.1 WRTTN Media can only be liable insofar as it is based on a legal or contractual attributable failure.

13.2 WRTTN Media’s liability is limited to the maximum amount of the compensation that WRTTN Media has received for the Services.

13.3 WRTTN Media is not liable for any information provided by third parties or for damage as a result of that information, nor is WRTTN Media liable for content on any sites linked to or from the Website.

13.4 WRTTN Media is not liable for damage of any kind caused by incorrect and/or incomplete data or information provided by or on behalf of the Client.

13.5 WRTTN Media is not liable for shortcomings in the performance of tasks caused by inadequate data provision by the Client.

13.6 WRTTN Media is never liable for direct or indirect damage of the Client who entered into an agreement in the course of their own profession or business, including stagnation, lost profit, lost savings and consequential damage in any way related to the execution of the work by WRTTN Media nor the application of information made available by WRTTN Media. This also includes any emotional troubles or mental health issues of the Client. The activities of WRTTN Media are not a replacement of therapy, and it’s the Client’s personal responsibility to monitor their emotional needs.

13.7 WRTTN Media is not liable for any direct or indirect damage or loss or lost profit, as a result of force majeure on the part of WRTTN Media. Force majeure also includes natural disasters, epidemics and pandemics, interruptions in the supply of power, restrictive measures and directions from the government, illness and other circumstances beyond the control of WRTTN Media.

13.8 WRTTN Media has the right, if possible, to undo damages.

13.9 WRTTN Media cannot guarantee a particular uptime of the Website. The digital content may therefore be unavailable for short periods. The Client is not entitled to compensation during downtime of the Website or online Services, when such downtime remains within reasonable proportions. WRTTN Media makes every effort, but does not guarantee, that online services are available again within 48 hours.

13.10 The limitations of liability included in these conditions do not apply if the damage is due to intent or gross negligence of WRTTN Media or its possible hired third parties.

14. Confidentiality

14.1 Both the Client and WRTTN Media are obliged to maintain the confidentiality of personal information that they’ve obtained through the agreement from each other or from another source, regardless of whether it is of a written or oral nature and from whomever it originates. Information counts as confidential if so communicated by the other party or if this arises from the nature of the information.

14.2 The (personal) data provided to the Client will be treated confidentially. The information provided is recorded in a file for administration. This will not be made available to third parties.

14.3 WRTTN Media values consent so I will request the incorporation and publication of the Client’s first name, (if possible their photograph) and their testimony as a reference for products and services. Once permission is given, WRTTN Media reserves the right to share these publicly as a testimonial.

15. Complaints and Disagreements

15.1 All disputes, complaints or objections to provided services, products, or invoices must be submitted by email as soon as possible after the complaints have been made.

15.2 Complaints or objections that are submitted do not suspend the obligation of payment.

15.3 Complaints that are submitted will be dealt with within 14 days, during which WRTTN Media will endeavor to achieve the best possible solution. If the complaint cannot be remedied within 14 days, WRTTN Media will report this in good time and give an indication of the time period within which a solution may be expected.

15.4 If no joint solution is reached, the disputes will be settled through legal proceedings in court.

15.5 All judicial and extrajudicial costs reasonably incurred, which are the result of non-compliance by the Client with obligations arising from the agreement, are for the account of the Client.

16. Applicable law

16.1 Dutch law applies to this terms of service.
